How much do you owe your spouse?  Or how much does your spouse owe you?

 

When it comes to child and spousal support, the answer isn’t always so simple.  While New York and New Jersey do provide guidelines for calculating support, the law allows the opportunity to argue additional factors that can fundamentally alter the Court’s calculations. 

 

Ask yourself: What standard of living have our children enjoyed during our marriage?  What are my children’s physical, emotional, and health needs?  Do I have the resources required to provide for those needs?

 

The answer to each of these questions can profoundly impact how much child support you owe or how much is owed to you.

 

Even your spouse’s income — the number at the heart of the child support calculations — may not be a straightforward affair. 

At Kors Law Group, we’ll thoroughly examine your spouse’s finances and annual earnings, and if it appears that significant wealth is being hidden or purposely diminished, we’ll petition the Court to impute income to your spouse, increasing the recorded income for the support calculations.

 

There’s similar flexibility in the way that the states calculate spousal support, also known as alimony or maintenance.  New York’s maintenance guidelines use the length of the marriage and the size of the parties’ income to provide two ranges: one, a financial span indicating the lowest and highest support amount, and two, a span of time indicating the shortest and longest duration for spousal support.

 

From there, it’s our job at Kors Law Group to negotiate for our clients and capture the outcome you’re looking for — whether it’s the highest or lowest level of support, the longest or shortest duration.
