What does marriage mean to you?

The states of New York and New Jersey have highly defined visions of what marriage is and what should happen to spouses and their children if a partnership ends.

The law sets clear guidelines as to how divorcing spouses divide their physical possessions, their savings and retirement accounts, as well as how much alimony and child support should be allotted and for how long.

But it doesn't have to be that way. With a prenuptial agreement, you and your spouse make all of those decisions. You decide how to divide your possessions, how to allot spousal and child support, and how much parenting time you and your fiance would get if your marriage comes to an end.

Of course, it is an unsettling proposition to contemplate the end of a marriage when your love is still strong and your union is just taking flight. But prenups don't have to be distressing propositions.

We see prenups like insurance. It may be awkward to contemplate getting severely ill, but we make the responsible choice and purchase health insurance for precisely that reason. Likewise, from our years in matrimonial law, we've seen how the truly awkward outcome is not (italics) preparing a prenup — thereby ceding all control to the state and its view of what a marriage should be.

The way we see it at Kors Law Group, collaborating with a fiance on a prenup doesn't have to be an awkward encounter. Instead, the prenup can serve as a "set it and forget it" document, allowing you and your fiance to decide for yourselves what a marriage means to you. And if, as planned, the marriage proceeds till death do us part, you never have to think about the agreement again.

Of course, if you and your spouse didn't create a prenup, you're not out of options.

At Kors Law Group, we help clients craft post-nuptial agreements, laying out the terms for your family, with the end of your marriage.

Post-nuptial agreements are components of an uncontested divorce. For many families, post-nups are (and should be) the first option, with the parties negotiating a resolution without going to battle.

If both parties agree to ending the marriage and generally agree on the terms, a post-nuptial agreement provides the best option, allowing you to move on without a bitter court battle.
